A professional clinical evaluation conducted by a licensed mental health provider can help your case with the United
States Citizenship and Immigration Services (USCIS). Some cases may require a current diagnosis for a prior behavioral
health problem such us a
Substance Related Disorder in Remission (Alcohol Abuse/Dependence or similar disorders).
In those instances, a current diagnosis can help bring in perspective of the progress made from the time of the last
substance related offense (i.e. DUI) to the present time. Other cases, may relate to the extreme hardship US citizens
will suffer if a
Cancellation of Removal is not granted to a relative who is of critical importance to the wellbeing of a US
citizen. Yet other cases may benefit from presenting the psychological trauma suffered in the country of origin by some
individuals seeking
Political Asylum. However, there are three (3) very common cases in which a professional
immigration clinical evaluation is very likely to help:
extreme hardship, domestic abuse and victims of crime.

Extreme Hardship:
Applicants filing Form I-601 seeking a Waiver under Section 212(a) of the Immigration and
Nationality Act (INA), as amended, as part of the adjudication requirements for a Form I-130, Immigrant Petition for
Relative, Fiancé (e) or Orphan may benefit from attaining an Extreme Hardship psychosocial evaluation to examine the
impact that the removal of the undocumented immigrant relative is having or will have in the life of a United States
Citizen (USC) or a United States Lawful Permanent Resident (USLPR). Although only undue extreme hardship to the USC
or USLPR relative is relevant to the case, the exacerbation of health problems or psychological dysfunction on the
undocumented immigrant relative is still important because it may cause additional stressors for the USC or USLPR.
Medical, mental health, educational, work, family, cultural and other added stressors are accounted for during the
psychosocial evaluation prior to the completion of an evaluation report.

Domestic Abuse: Applicants filing Form I-360 (Petition for Amerasian, Widow(er), or Special Immigrant) must establish
the presence of domestic abuse in order to file for legal status (separately from their USC spouse). The Domestic Abuse
psychosocial evaluation determines if abuse is present and the overall psychological impact of the abuse on the victim.
Sometimes the abuse is obvious (physical/sexual), but at other times it is subtle (mental/emotional) and only a
thorough clinical evaluation can determine the extent of the psychological abuse. Abuse can be physical, sexual,
emotional or psychological. The purpose of abuse is almost always to get power and control over the victim and it is not
limited to male over female but cross gender lines, women can also be the abusive partner in heterosexual
relationships.

Victim of Crime: Applicants filing Form I-918 (Petition for U Nonimmigrant Status - U Visa) have been victims of a crime
and are willing to assist law enforcement and government officials in the investigation or prosecution of the criminal
activity. USCIS grants up to 10,000 visas per year to victims of assault, armed robbery, rape, incest, sexual assault and
other serious crimes. After three years, individuals with a U Visa can adjust their status to Permanent Residents. To be
eligible you must have suffered substantial physical or mental abuse as a result of having been a victim of a qualifying
criminal activity; you must have information concerning that criminal activity and you must have been helpful, are being
helpful, or will be helpful in the investigation or prosecution of the crime.
