Q - I have two DUI offenses, and the judge did not tell me I had to do DUI School.

Do I have to do it?
A - A judge, probation officer or even your attorney might not necessarily advise you of
every step you must take in order to get your Georgia Driver's license reinstated. The
best and most accurate source of information is the Department of Driver's Services.
DDS will inform you that
you must complete the Risk Reduction Program (DUI School).
In addition, a Multiple DUI Offender (2 in 10 years after July 1st 2008 or 2 in 5 years if
prior to July 1st, 2008), must also complete a Clinical Evaluation and follow all treatment
recommendations prior to applying for a license reinstatement.
Q- I was arrested and charged with Simple Battery against my partner. Should I

start a Family Violence Intervention Program before I go to court?
A- It is advisable, but ultimately it depends on your assessment of your on case and
what you objectively believe are your chances for a conviction. If there is a strong case
against you, it might be advisable to begin the program before you appear in court since
if convicted you will have to complete the program as part of your sentence. An attorney
can use your willingness to seek help in your favor.
Q- I have two DUI's within a ten-year period, for how long is my license

 suspended?
A - Most individuals who fall under the New DUI Offender Law as stated in House Bill 336
(HB 336) have their driving privileges suspended for 18 months. You might be able to
obtain a Limited Driving Permit once you have completed all the license reinstatement
requirements as stated by DDS and once you have completed the mandatory hard time
suspension.
Q - I had a DUI conviction in another state with my Georgia Driver's License. Can
I clear my driving record in Georgia?
A- Once you have satisfied the reinstatement requirements from the state that issued
the suspension, you should receive a Letter of Clearance from their Department of Driver
services or Department of Motor Vehicles. This letter will help you start the process of
attaining or reinstating your driver's license in the State of Georgia. Be mindful that the
State of Georgia might impose additional requirements in order to issue or reinstate
your Georgia Driver's license.
Q - My spouse has a deportation process pending. It would be detrimental to

our family should she/he be removed from the family. Are there any options?
A - Yes. There is legal help for spouses of US Citizens or Lawful Permanent Residents
of the US that would face extenuating circumstances should a family member or a
spouse be deported from the United States. Call 770-220-2885 to schedule an initial
consultation about your case. We will help you select an Immigration Attorney who will
